Privacy notice concerning the 3G outphasing

Your privacy is important to you and to us, which is why we want to be transparent about what we do with your personal data.

In this document, you can find information on the processing of your personal data by Proximus in the context of the 3G outphasing. This information includes what personal data we collect about you, how we process your personal data and with whom it will be shared. We also describe what your data subject rights are and how you can exercise them.

2. Who is the data controller?

The controller of the processing of your personal data described in this privacy notice is Proximus SA under public law, with its registered office at Bd du Roi Albert II, 27, 1030 Brussels, Belgium - registered at the ECB under number 0202.239.951.

3. For what purposes does Proximus use your personal data?

Your personal data are collected and processed for the purpose listed in this section. For this purpose, you will find an overview of the personal data that is collected and processed, the legal basis of the processing activity, the retention period of the personal data and the partners with whom personal data is shared.

What personal data will Proximus use?

Observed or generated data: Personal data in the context of electronic communications (traffic data).

All this data is aggregated to know the number of users with 2G/3G/4G/5G devices per antenna region.

What justifies this processing activity?

Our legitimate interest (art. 6(1)(f) GDPR) to monitor and ensure the good performance of our telecommunication network.

This processing activity is allowed in accordance with the exception of article 122, §4/1 and article 123, §1, 1° of the Belgian Electronic Communications Act. In particular, because the processing is necessary for the proper functioning of the mobile network and service.

How long will Proximus keep these data?

The aggregated data will be stored temporary, only to do the counts to know the number of devices using 2G, 3G, 4G or 5G, etc. in a specific area.

With whom does Proximus share these data?

The data will only be processed internally by Proximus and will not be shared with third parties.

To provide you with a fast, high-performance and sustainable mobile network, Proximus will discontinue 3G at the end of 2024. This will free up capacity to strengthen and extend our faster 4G and 5G networks.

The processing allows Proximus to understand how many devices are using 2G, 3G, 4G or 5G, etc. in a specific area. This helps Proximus decide for which locations it might be necessary to outphase old mobile communication standards which do no longer correspond to a proper state-of-the-art mobile network. This allows Proximus to use the freed-up space in the airwaves for improved mobile network by deploying a better technology (e.g. 4G or 5G). As a result, this will optimise the overall performance of the mobile network and services.

If you have older devices that are incompatible with 4G telephony, calls and texts will be sent over the 2G network, which will remain active. More info.

4. What are my privacy rights and how can I exercise them?

As a data subject, you have the following data subject rights:

  • You have the right to request access to your personal data.
  • You have the right to request the rectification of your personal data.
  • You have the right to object to the processing of your personal data. Please be aware that the right to object is not absolute and that it is subject to specific conditions.
  • You have the right to request the erasure of your personal data. Please be aware that the right to erasure is not absolute and that it is subject to specific conditions.
  • You have the right to request restriction of the processing of your personal data. Please be aware that this right is subject to specific conditions.
  • You have the right to request the transfer of personal data you provided to Proximus to yourself or a third party.
